Mr. Ellenberg, formerly a partner at LeBouef, Lamb, Leiby & MacRae, has spent most of his career in the defense of insurers and their insureds. During the past 22 years, Mr. Ellenberg has been most actively involved in the defense of physicians in malpractice cases. In the past he has represented architectural firms, engineers and construction managers, including Gibbs & Hill, Inc. and TAMS, and defended product manufacturers. He has handled numerous trials and appeals, most significantly McDougald v. Garber and its companion case Nussbaum v. Gibstein, in which the New York State Court of Appeals eliminated "loss of enjoyment of life" as a separate element of damages in personal injury cases. Mr. Ellenberg's practice also includes commercial litigation of all types.
